ALLGEMEINE GESCHÄFTSBEDINGUNGEN (DEUTSCH)
Der Käufer erklärt ausdrücklich, den Kauf für Zwecke zu tätigen, die nicht im Zusammenhang mit einer ausgeübten gewerblichen oder beruflichen Tätigkeit stehen.
Der Käufer darf die Fotos nicht ohne vorherige schriftliche Genehmigung veröffentlichen.
Lieferant
Die unter diese AGB fallenden Produkte werden vom Zentrum für Wasserkristallfotografie - Rainer Niederkofler mit Sitz in Bruneck, Paul von Sternbach 1 angeboten, Steuernr. NDRRNR75C17B220J, Mehrwertsteuernummer 02663350219, nachfolgend "Lieferant" genannt.
1)DEFINITIONEN
1.1 Der Begriff "Online - Kaufvertrag" bezeichnet den Kaufvertrag, der sich auf kundenspezifische Fotos des Lieferanten bezieht, der zwischen dem Lieferanten und dem Käufer im Rahmen eines Fernabsatzsystems durch telematische Systeme des Lieferanten abgewickelt wird.
1.2 Der Begriff "Käufer" bezieht sich auf den Verbraucher, der eine natürliche Person ist, die den Kauf für Zwecke vornimmt, die nicht im Zusammenhang mit einer gewerblichen oder beruflichen Tätigkeit stehen.
1.3 Der Begriff "Lieferant" bezieht sich auf das Subjekt, der im Epigraph angegeben ist, oder auf das Subjekt, das die Informationsdienste anbietet.
2) GEGENSTAND DES VERTRAGS
2.1 Mit dem vorliegenden Vertrag verkauft der Lieferant und der Käufer kauft personalisierte Fotografien auf der Website http://www.wasserkristalle.eu per Fernabsatzgeschäft.
2.2 Die im vorhergehenden Punkt genannten Produkte werden auf der Webseite http://www.wasserkristalle.eu präsentiert.
3) VERFAHREN ZUM ABSCHLUSS DES VERTRAGES
Der Vertrag zwischen dem Lieferanten und dem Käufer kommt ausschließlich über das Internet zustande, mittels Zugriff des Käufers auf die Seite http://www.wasserkristalle.eu. Dort folgt der Käufer der angegebenen Kaufprozedur.
4) ABSCHLUSS UND WIRKSAMKEIT DES VERTRAGES
4.1 Der Kaufvertrag kommt durch das exakte Ausfüllen des Antragsformulars und die Zustimmung zum Kauf zustande. Die Einwilligung zum Kauf wird online an den Verkäufer übermittelt.Der Käufer sieht auf einer Webseite die druckbare Bestellübersicht, die die Details der Bestellung, den Preis der gekauften Waren, Zahlungsmethoden und -bedingungen, Lieferzeiten und das Widerrufsrecht zusammenfasst.
4.2 Wenn der Lieferant die Bestellung vom Käufer erhält, sendet er eine Bestätigungs-E-Mail oder zeigt eine druckbare Webseite mitBestätigung und Übersicht der im vorherigen Punkt dargestellten Daten.
4.3 Der Vertrag gilt nicht als vollständig und wirksam zwischen den Parteien, wenn Inhalte laut vorherigem Punkt fehlen.
5) ZAHLUNGSWEISE UND RÜCKERSTATTUNG
5.1 Jede Zahlung durch den Käufer kann nur nach einer der Methoden vorgenommen werden, die vom Lieferanten auf der entsprechenden Webseite angegeben sind.
5.2 Jegliche eventuelle Rückerstattung an den Käufer erfolgt rechtzeitig auf eine der vom Lieferanten vorgeschlagenen und vom Käufer gewählten Methoden-
5.3 Alle Mitteilungen in Bezug auf Zahlungen erfolgen auf einer speziellen Linie des Lieferanten, die durch ein Verschlüsselungssystem geschützt ist. Der Lieferant garantiert die Speicherung dieser Informationen mit einer zusätzlichen Sicherheitsverschlüsselung und in Übereinstimmung der geltenden Vorschriften zum Schutz personenbezogener Daten.
5.4 Jede Zahlung durch den Käufer kann nur nach einer der Methoden vorgenommen werden, die vom Lieferanten auf der entsprechenden Webseite angegeben sind.
5.5 Jegliche eventuelle Rückerstattung an den Käufer erfolgt rechtzeitig auf eine der vom Lieferanten vorgeschlagenen und vom Käufer gewählten Methoden-
5.6 Alle Mitteilungen in Bezug auf Zahlungen erfolgen auf einer speziellen Linie des Lieferanten, die durch ein Verschlüsselungssystem geschützt ist. Der Lieferant garantiert die Speicherung dieser Informationen mit einer zusätzlichen Sicherheitsverschlüsselung und in Übereinstimmung der geltenden Vorschriften zum Schutz personenbezogener Daten.
6) LIEFERZEITEN UND LIEFERMETHODE
6.1 Der Lieferant kann mit der Erstellung des personalisierten Fotos beginnen, nachdem die Zahlung geleistet wurde und nachdem er vom Käufer die folgenden Anforderungen erhalten hat:

Texte oder
Sprachdatei oder
Wasser oder Flüssigkeiten, die analysiert werden sollen (mit einer schriftlichen Mitteilung über Herkunft und/ oder Behandlung)
6.2 Fotos, Texte oder Sprachdateien werden dem Lieferanten elektronisch an die Adresse info@wasserkristalle.eu übermittelt. Das zu analysierende Wasser oder die Flüssigkeiten werden an folgende Adresse geschickt: Zentrum für Wasserkristallfotografie - Rainer Niederkofler, Paul von Sternbach 1, 39031 Bruneck (Italien).
6.3 Der Lieferant sendet die Kristallfotos im JPEG-Format an die E-Mail-Adresse des Käufers.
6.4 Die Versandzeiten können nach Erfüllung der Bedingungen lt. Punkt 6.1 von einem Tag bis zu maximal 30 Arbeitstagen ab Bestätigung derselben variieren. Sollte der Lieferant nicht in der Lage sein die Lieferung innerhalb dieser Frist durchzuführen, wird der Käufer unverzüglich per E-Mail darüber verständigt.
6.5 Der Lieferant behält sich das Recht vor, Analysen abzulehnen.
6.6 Der Lieferant stellt die Kristallbilder in einer Auflösung von 19,8 Megapixel und im Format jpeg zur Verfügung.
6.7 Der Lieferant überträgt das Copyright der Fotos an den Käufer.
7) PREISE
7.1 Alle Verkaufspreise werden auf der Website http://www.wasserkristalle.eu in Euro angezeigt.
7.2 Die Verkaufspreise, auf die im vorhergehenden Punkt Bezug genommen wird, beinhalten Mehrwertsteuer und andere Steuern. Eventuelle Versandkosten und zusätzliche Kosten (zB Zollabfertigung), auch wenn diese nicht im Kaufpreis enthalten sind, müssen im Kaufvorgang und in der Bestellübersichtsseite angegeben werden, bevor die Bestellung vom Käufer aufgegeben wird,
8) HAFTUNGSBESCHRÄNKUNG
8.1 Der Lieferant übernimmt keine Verantwortung für Schäden aufgrund höherer Gewalt, wenn er die Bestellung nicht innerhalb der vertraglich festgelegten Frist ausführt.
8.2 Der Lieferant haftet gegenüber dem Käufer nur bei Vorsatz oder grober Fahrlässigkeit. Für Ineffizienzen oder Störungen im Zusammenhang mit der Nutzung des Internets außerhalb seiner eigenen Kontrolle oder seiner Sublieferanten haftet der Verkäufer nicht.
8.3 Der Lieferant haftet nicht für Schäden, Verluste und Kosten, die dem Käufer infolge der Nichtausführung des Vertrags entstehen, wenn die Gründe nicht beim Lieferanten liegen. Der Käufer hat in diesem Fall nur Anspruch auf die volle Rückerstattung des gezahlten Preises und aller zusätzlichen Kosten, die eventuell entstanden sind.
8.4 Der Lieferant übernimmt keine Verantwortung für betrügerische und illegale Nutzung, die durch Dritte, Kreditkarten, Schecks und andere Zahlungsmittel bei Zahlung der gekauften Produkte vorgenommen werden können, wenn sich herausstellt, dass alle möglichen Vorkehrungen auf der Grundlage der besten Wissenschaft und Erfahrung des Augenblicks und auf der Grundlage der üblichen Sorgfalt getroffen wurden.
8.5 Unter keinen Umständen kann der Käufer für Verzögerungen oder Fehler bei der Zahlung haftbar gemacht werden, wenn er nachweist, dass er die Zahlung in der vom Lieferanten angegebenen Zeit und Weise geleistet hat.
9) VERPFLICHTUNGEN DES KÄUFERS
9.1 Der Käufer verpflichtet sich, den Preis der gekauften Ware zu den im Vertrag angegebenen Zeiten und Methoden zu bezahlen.
9.2 Der Käufer verpflichtet sich, nach Abschluss des Online-Kaufvorgangs für Druck und Aufbewahrung des Vertrages zu sorgen.
9.3 Die in diesem Vertrag enthaltenen Informationen wurden bereits vom Käufer eingesehen und akzeptiert. Dieser Schritt ist vor der Kaufbestätigung obligatorisch.
9.4 Der Käufer ist in Kenntnis gesetzt, dass sich die vorliegende Methode von herkömmlichen Wasseruntersuchungen unterscheidet.Die vorliegende Methode zeigt eine informative und energetische Ebene des Wassers.
9.5 Der Käufer ist in Kenntnis gesetzt, dass die vorliegende Analyse die gesetzlich vorgeschriebenen Trinkwasseruntersuchungen nicht ersetzt.
9.6 Die Kristallbilder dürfen nicht dazu verwendet werden, Wässer als Heilwässer zu erklären.
9.7 Der Lieferant übernimmt keine Haftung für die Verwendung der Wasserkristallbilder. Der Käufer verzichtet auf jegliche Gewährleistungsansprüche und Geltendmachung von Ansprüchen in diesem Zusammenhang.
9.8 Der Käufer darf dem Lieferanten keine Flüssigkeiten, diegefährlich oder gesundheitsschädlich sind, zusenden.
9.9 Die Transportkosten für übermittelte Flüssigkeiten übernimmt der Käufer.
10) RÜCKTRITTSRECHT
Nach Art. 59, Abs. c des Verbrauchergesetzes besteht kein gesetzliches Widerrufs- oder Rückgaberecht für die angebotenen Leistungen. Art. 59 schließt das Widerrufsrecht für „individuell hergestellte und personalisierte Güter“ aus.
11) URSACHEN DER AUFLÖSUNG
Die unter Punkt 9.1 genannten Verpflichtungen, die vom Käufer übernommen wurden, und die Garantie des erfolgreichen Abschlusses der Zahlung, die der Käufer mit den Mitteln nach Art. 5.1 durchführt, sowie die genaue Erfüllung der vom Lieferanten unter Punkt 6 übernommenen Verpflichtungen sind wesentlich.Die Nichteinhaltung einer dieser Verpflichtungen, sofern sie nicht durch Zufall oder höhere Gewalt bestimmt werden, führt zur Auflösung des Vertrags ex Art.1156 des Bürgerlichen Gesetzbuches, ohne die Notwendigkeit einer gerichtlichen Entscheidung.
12) SCHUTZ DER VERTRAULICHKEIT UND VERARBEITUNG DER DATEN DES KÄUFERS
12.1 Der Lieferant schützt die Privatsphäre seiner Kunden und gewährleistet, dass die Daten in Übereinstimmung mit den Bestimmungen des Datenschutzgesetzes (Legislativdekret vom 30. Juni 2003, Nr. 196) behandelt werden.
12.2 Die persönlichen Daten sowie Finanzdaten, die durch den Lieferanten Zentrum für Wasserkristallfotografie - Rainer Niederkofler direkt und/oder durch Dritte erhalten werden, werden in Papier- oder telematischer Form gesammelt und verarbeitet, mit dem Ziel, den Auftrag zu registrieren und das Verfahren zur Durchführung des vorliegenden Vertrages zu aktivieren. Darüber hinaus dient die Prozedur als notwendige Kommunikation zusätzlich zur Erfüllung der gesetzlichen Verpflichtungen sowie für eine wirksame Verwaltung der Geschäftsbeziehungen zur Erbringung des besten Dienstes (Artikel 24, Absatz 1, Buchstabe b des Gesetzesdekrets Nr. 196/2003).
12.3 Der Lieferant verpflichtet sich, Daten und Informationen, die von dem Käufer zur Verfügung gestellt werden, vertraulich zu behandeln und sie nicht an unberechtigte Personen weiterzugeben, sie weder für andere Zwecke zu verwenden, als die, für die sie erhoben wurden oder an Dritte zu übertragen. Diese Daten dürfen nur auf Anfrage der Justizbehörde oder anderer gesetzlich zugelassener Behörden vorgelegt werden.
12.4 Die personenbezogenen Daten werden nach der Unterzeichnung einer Vertraulichkeitsvereinbarung nur an delegierte Dritte weitergegeben, die notwendige Tätigkeiten zur Durchführung des Vertrages ausüben.
12.5 Der Käufer genießt die in Art. 7 des gesetzesvertretenden Dekrets
196/03 enthaltenen Rechte.
12.6 Die Übermittlung personenbezogener Daten durch den Käufer ist eine notwendige Voraussetzung für die korrekte und rechtzeitige Erfüllung dieses Vertrages. Andernfalls kann die Anfrage des Käufers nicht ausgeführt werden.
12.7 In jedem Fall werden die erfassten Daten für einen Zeitraum gespeichert, der nicht über den Zeitraum hinausgeht, der für die Zwecke erforderlich ist, für die sie erhoben oder später verarbeitet wurden. Ihre Entfernung wird in sicherer Art und Weise durchgeführt.
12.8 Inhaber der erhobenen und verarbeiteten personenbezogenen Daten ist der Lieferant, an den der Käufer jede Anfrage stellen kann.
13) VERFAHREN ZUR ARCHIVIERUNG DES VERTRAGES
Gemäß Art. 12 D.L.vo 70/03, informiert der Lieferant den Käufer, dass jede übermittelte Bestellung in digitaler Form auf dem Server des Lieferanten nach den Kriterien der Vertraulichkeit und Sicherheit aufbewahrt wird.
14) KOMMUNIKATIONEN UND BESCHWERDEN
Direkte schriftliche Mitteilungen an den Lieferanten und eventuelle Beanstandungen gelten nur als gültig, wenn sie an folgende Adresse gesendet werden: Zentrum für Wasserkristallfotografie - Rainer Niederkofler, Paul von Sternbach 1, 39031 Bruneck oder per E-Mail an folgende Adresse info@wasserkristalle.eu. Der Käufer muss im Anmeldeformular seinen Wohnsitz oder Domizil oder seine E-Mail-Adresse angeben, an die er Mitteilungen des Lieferanten erhalten möchte.
15) ANWENDBARES RECHT UND REFERENZ
Dieser Vertrag unterliegt italienischem Recht.
16) Schlussklausel
Dieser Vertrag hebt alle Vereinbarungen, Einverständnisse, Verhandlungen, schriftlichen oder mündlichen Übereinkünfte, auf, die zuvor zwischen den Parteien getroffen wurden und den Gegenstand dieses Vertrags betreffen.

L’Acquirente dichiara espressamente di compiere l’acquisto per fini estranei all’attività commerciale o professionale esercitata.
L'Acquirente non può pubblicare le foto senza previa autorizzazione scritta.
Fornitore
I beni oggetto delle presenti condizioni generali sono posti in vendita da Zentrum für Wasserkristallfotografie - Rainer Niederkofler con sede in Brunico, via Paul von Sternbach n. 1, codice fiscale n.NDRRNR75C17B220J, partita IVA n. 02663350219, di seguito indicata come «Fornitore»,
1) DEFINIZIONI
1.1 Con l'espressione «contratto di vendita on line», s'intende il contratto di compravendita relativo a fotografie personalizzate del Fornitore, stipulato tra questi e l'Acquirente nell'ambito di un sistema di vendita a distanza tramite strumenti telematici, organizzato dal Fornitore.
1.2 Con l'espressione «Acquirente» si intende il consumatore persona fisica che compie l'acquisto, di cui al presente contratto, per scopi non riferibili all'attività commerciale o professionale eventualmente svolta.
1.3 Con l’espressione «Fornitore» si intendono il soggetto indicato in epigrafe ovvero il soggetto prestatore dei servizi di informazione.
2) OGGETTO DEL CONTRATTO
2.1 Con il presente contratto, rispettivamente, il Fornitore vende e l'Acquirente acquista a distanza tramite strumenti telematici fotografie personalizzate indicate ed offerte in vendita sul sito http://www.wasserkristalle.eu
2.2 I prodotti di cui al punto precedente sono presentati nella pagina web: http://www.wasserkristalle.eu.
3) MODALITÀ DI STIPULAZIONE DEL CONTRATTO
Il contratto tra il Fornitore e l'Acquirente si conclude esclusivamente attraverso la rete internet mediante l'accesso dell’Acquirente all'indirizzo http://www.wasserkristalle.eu, seguendo le procedure indicate.
4) CONCLUSIONE ED EFFICACIA DEL CONTRATTO
4.1 Il contratto di acquisto si conclude mediante l'esatta compilazione del modulo di richiesta ed il consenso all'acquisto manifestato tramite l'adesione inviata on line sempre previa visualizzazione di una pagina web di riepilogo dell’ordine, stampabile, nella quale sono riportati gli estremi dell'ordinante e dell'ordinazione, il prezzo del bene acquistato, le modalità e i termini di pagamento, i tempi della consegna e l'esistenza del diritto di recesso.
4.2 Nel momento in cui il Fornitore riceve dall'Acquirente l'ordinazione provvede all'invio di una e-mail di conferma oppure alla visualizzazione di una pagina web di conferma e riepilogo dell’ordine, stampabile, nella quale siano anche riportati i dati richiamati nel punto precedente.
4.3 Il contratto non si considera perfezionato ed efficace fra le parti in difetto di quanto indicato al punto precedente.
5) MODALITA’ DI PAGAMENTO E RIMBORSO
5.1 Ogni pagamento da parte dell'Acquirente potrà avvenire unicamente per mezzo di uno dei metodi indicati nell'apposita pagina web dal Fornitore.
5.2 Ogni eventuale rimborso all’Acquirente verrà accreditato mediante una delle modalità proposte dal Fornitore e scelta dall'Acquirente, in modo tempestivo,
5.3 Tutte le comunicazioni relative ai pagamenti avvengono su una apposita linea del Fornitore protetta da sistema di cifratura. Il Fornitore garantisce la memorizzazione di queste informazioni con un ulteriore livello di cifratura di sicurezza e in ossequio di quanto previsto dalla vigente disciplina in materia di tutela dei dati personali.
5.4 Ogni pagamento da parte dell'Acquirente potrà avvenire unicamente per mezzo di uno dei metodi indicati nell'apposita pagina web dal Fornitore.
5.5 Ogni eventuale rimborso all’Acquirente verrà accreditato mediante una delle modalità proposte dal Fornitore e scelta dall'Acquirente, in modo tempestivo,
5.6 Tutte le comunicazioni relative ai pagamenti avvengono su una apposita linea del Fornitore protetta da sistema di cifratura. Il Fornitore garantisce la memorizzazione di queste informazioni con un ulteriore livello di cifratura di sicurezza e in ossequio di quanto previsto dalla vigente disciplina in materia di tutela dei dati personali.
6) TEMPI E MODALITÀ DELLA CONSEGNA
6.1 Il Fornitore può iniziare a creare la fotografia personalizzata dopo l’avvenuto pagamento e dopo aver ricevuto da parte dell’aquirente i requisiti seguenti:

Acqua o liquidi da analizzare (con descrizione di origine e / o trattamento)
6.2 Le fotografie, i testi o i file voce vangono trasmessi al Fornitore in via telematica, all’indirizzo: info@wasserkristalle.eu. L’acqua ovvero liquidi da analizzare vengono spediti all’indirizzo seguente: Zentrum für Wasserkristallfotografie - Rainer Niederkofler, Paul von Sternbach 1, 39031 Brunico (Italia).
6.3 Il Fornitore spedisce le fotografie dei cristalli in formato jpeg all’indirizzo mail dell’acquirente.
6.4 I tempi della spedizione possono variare dal giorno stesso del ricevimento dei requisiti da analizzare (punto 6.1)ad un massimo di 30 giorni lavorativi dalla conferma dello stesso. Nel caso in cui il Fornitore non sia in grado di effettuare la spedizione entro detto termine ma, comunque, entro quello indicato al punto seguente, ne verrà dato tempestivo avviso tramite e-mail all'Acquirente.
6.5Il Fornitore si riserva il diritto di rifiutare le analisi.
6.6 Il Fornitore fornisce le foto di cristallo in una risoluzione di 19.8 megapixel e in formato jpeg.
6.7 Il Fornitore trasferisce il copyright delle foto all'acquirente.
7) PREZZI
7.1 Tutti i prezzi di vendita dei prodotti esposti ed indicati all'interno del sito Internet http://www.wasserkristalle.eu, sono espressi in euro e costituiscono offerta al pubblico ai sensi dell'art. 1336 c.c.
7.2 I prezzi di vendita, di cui al punto precedente, sono comprensivi di IVA e di ogni eventuale altra imposta. I costi di spedizione e gli eventuali oneri accessori (es. sdoganamento), se presenti, pur non ricompresi nel prezzo di acquisto, devono essere indicati e calcolati nella procedura di acquisto prima dell’inoltro dell’ordine da parte dell’acquirente ed altresì contenuti nella pagina web di riepilogo dell’ordine effettuato.
8) LIMITAZIONI DI RESPONSABILITÀ
8.1 Il Fornitore non assume alcuna responsabilità per disservizi imputabili a causa di forza maggiore, nel caso non riesca a dare esecuzione all’ordine nei tempi previsti dal contratto.
8.2 Il Fornitore non potrà ritenersi responsabile verso l’Acquirente, salvo il caso di dolo o colpa grave, per disservizi o malfunzionamenti connessi all’utilizzo della rete internet al di fuori del controllo proprio o di suoi sub-fornitori.
8.3 Il Fornitore non sarà inoltre responsabile in merito a danni, perdite e costi subiti dall’Acquirente a seguito della mancata esecuzione del contratto per cause a lui non imputabili, avendo l'Acquirente diritto soltanto alla restituzione integrale del prezzo corrisposto e degli eventuali oneri accessori sostenuti.
8.4 Il Fornitore non assume alcuna responsabilità per l'eventuale uso fraudolento ed illecito che possa essere fatto da parte di terzi, delle carte di credito, assegni ed altri mezzi di pagamento, all'atto del pagamento dei prodotti acquistati, qualora dimostri di aver adottato tutte le cautele possibili in base alla miglior scienza ed esperienza del momento ed in base alla ordinaria diligenza.
8.5 In nessun caso l’Acquirente potrà essere ritenuto responsabile per ritardi o disguidi nel pagamento qualora dimostri di aver eseguito il pagamento stesso nei tempi e modi indicati dal Fornitore.
9) OBBLIGHI DELL'ACQUIRENTE
9.1 L’Acquirente si impegna a pagare il prezzo del bene acquistato nei tempi e modi indicati dal Contratto.
9.2 L'Acquirente si impegna, una volta conclusa la procedura d'acquisto on line, a provvedere alla stampa ed alla conservazione del presente contratto.
9.3 Le informazioni contenute in questo contratto sono state, peraltro, già visionate ed accettate dall'Acquirente, che ne dà atto, in quanto questo passaggio viene reso obbligatorio prima della conferma di acquisto.
9.4 L'acquirente è informato che questo metodo differisce dai test convenzionali dell'acqua. Questo metodo mostra l'informazione e il livello di energia dell'acqua.
9.5 L'acquirente è informato che la presente analisi non sostituisce in alcun modo i test di acqua potabile richiesti dalla legge.
9.6 Le immagini di cristallo non possono essere utilizzate per presentare e descrivere l'acqua come acqua medicinale.
9.7 Il Fornitore non si assume alcuna responsabilità per l'uso delle immagini di cristalli d'acqua. L'acquirente rinuncia a qualsiasi richiesta di risarcimento in merito
9.8 L'acquirente non è autorizzato ad inviare al Fornitore liquidi pericolosi o dannosi per la salute.
9.9 I costi di trasporto per i liquidi trasportati sono a carico dell'acquirente.
10) DIRITTO DI RECESSO
Non può essere esercitato il diritto di recesso. Il Codice del Consumo, all'art. 59, lettera c) esclude il diritto di recesso per i contratti di “fornitura di beni confezionati su misura o chiaramente personalizzati”.
11) CAUSE DI RISOLUZIONE
Le obbligazioni di cui al punto 9.1, assunte dall'Acquirente, nonché la garanzia del buon fine del pagamento che l'Acquirente effettua con i mezzi di cui all'art. 5.1, ed altresì l'esatto adempimento degli obblighi assunti dal Fornitore al punto 6, hanno carattere essenziale, cosicché per patto espresso, l'inadempimento di una soltanto di dette obbligazioni, ove non determinata da caso fortuito o forza maggiore, comporterà la risoluzione di diritto del contratto ex art.1156 c.c., senza necessità di pronuncia giudiziale.
12) TUTELA DELLA RISERVATEZZA E TRATTAMENTO DEI DATI DELL'ACQUIRENTE
12.1 Il Fornitore tutela la privacy dei propri clienti e garantisce che il trattamento dei dati è conforme a quanto previsto dalla normativa sulla privacy di cui al D.Lgs. 30 giugno 2003, n. 196.
12.2 I dati personali anagrafici e fiscali acquisiti direttamente e/o tramite terzi dal Fornitore Rainer Niederkofler, titolare del trattamento, vengono raccolti e trattati in forma cartacea, informatica, telematica, in relazione alle modalità di trattamento con la finalità di registrare l'ordine ed attivare nei suoi confronti le procedure per l'esecuzione del presente contratto e le relative necessarie comunicazioni, oltre all'adempimento degli eventuali obblighi di legge, nonché per consentire una efficace gestione dei rapporti commerciali nella misura necessaria per espletare al meglio il servizio richiesto (art. 24, comma 1, lett. b, D.Lgs. n. 196/2003).
12.3 Il Fornitore si obbliga a trattare con riservatezza i dati e le informazioni trasmesse dall'Acquirente e di non rivelarle a persone non autorizzate, né ad usarle per scopi diversi da quelli per i quali sono stati raccolti o a trasmetterli a terze parti. Tali dati potranno essere esibiti soltanto su richiesta dell’autorità giudiziaria ovvero di altre autorità per legge autorizzate.
12.4 I dati personali saranno comunicati, previa sottoscrizione di un impegno di riservatezza dei dati stessi, solo a soggetti delegati all'espletamento delle attività necessarie per l'esecuzione del contratto stipulato e comunicati esclusivamente nell'ambito di tale finalità.
12.5 L'Acquirente gode dei diritti di cui all'art. 7 del D.L.vo 196/03.
12.6 La comunicazione dei propri dati personali da parte dell'Acquirente è condizione necessaria per la corretta e tempestiva esecuzione del presente contratto. In difetto, non potrà essere dato corso alla domanda dell'Acquirente stesso.
12.7 In ogni caso, i dati acquisiti saranno conservati per un periodo di tempo non superiore a quello necessario agli scopi per i quali sono stati raccolti o successivamente trattati. La loro rimozione avverrà comunque in maniera sicura.
12.8 Titolaredella raccolta e del trattamento dei dati personali, è il Fornitore, al quale l'acquirente potrà indirizzare presso la sede aziendale, ogni richiesta.
13) MODALITA' DI ARCHIVIAZIONE DEL CONTRATTO
Ai sensi dell'art. 12 del D.L.vo 70/03, il Fornitore informa l'Acquirente che ogni ordine inviato viene conservato in forma digitale sul server la sede del Fornitore stesso secondo criteri di riservatezza e sicurezza.
14) COMUNICAZIONI E RECLAMI
Le comunicazioni scritte dirette al Fornitore e gli eventuali reclami saranno ritenute valide unicamente ove inviate al seguente indirizzo: Zentrum für Wasserkristallfotografie - Rainer Niederkofler, Paul von Sternbach 1, 39031 Brunico ovvero inviate tramite e-mail al seguente indirizzo info@wasserkristalle.eu. L'Acquirente indica nel modulo di registrazione la propria residenza o domicilio o l'indirizzo di posta elettronica al quale desidera siano inviate le comunicazioni del Fornitore.
15) LEGGE APPLICABILE E RINVIO
Il presente contratto è regolato dalla legge italiana.
16) CLAUSOLA FINALE
Il presente contratto abroga e sostituisce ogni accordo, intesa, negoziazione, scritta od orale, intervenuta in precedenza tra le parti e concernente l'oggetto di questo contratto.

The purchaser expressly declares to make the purchase for purposes unrelated to the commercial or professional activity exercised.
The purchaser may not publish the photos without prior written permission.
Supplier
The products covered by these terms and conditions are offered by Zentrum für Wasserkristallfotografie - Rainer Niederkofler with office in Brunico, street Paul von Sternbach tax code no. NDRRNR75C17B220J, VAT number n. 02663350219, hereinafter referred to as supplier.
1) DEFINITIONS
1.1 The term "online sales contract" means the purchase contract relating to customized photographs of the supplier, stipulated between the supplier and the purchaser in the context of a distance selling system through telematic tools, organized by the supplier.
1.2 The term "purchaser" refers to the consumer who is a physical person who makes the purchase not related to the commercial or professional activity.
1.3 The term "supplier" refers to the subject indicated in the epigraph or the subject providing the information services.
2) SUBJECT OF THE CONTRACT
2.1 With this contract the supplier sells, and the purchaser purchases remotely personalized photographs offered on the website http://www.wasserkristalle.eu.
2.2 The products referred to in the previous point are presented on the web page: http://www.wasserkristalle.eu.
3) METHOD OF STIPULATING THE CONTRACT
The contract between the supplier and the purchaser is concluded exclusively through the Internet by accessing at http://www.wasserkristalle.eu following the procedures indicated.
4) CONCLUSION AND EFFECTIVENESS OF THE CONTRACT
4.1 The purchase contract is concluded by the exact completion of the application form and the consent to the purchase manifested through the adhesion sent online always after viewing a web page of order summary, printable, which shows the details of the ordering, the price of the purchased good, payment methods and terms, delivery times and the right of withdrawal.
4.2 When the supplier receives the order from the purchaser, it sends a confirmation e-mail or displays a printable confirmation and summary web page containing the data showed in the previous point.
4.3 The contract is not considered complete and effective between the parties if content indicated in the previous point is missing.
5) METHOD OF PAYMENT AND REFUND
5.1 Each payment by the purchaser can be done only by the methods indicated in the appropriate web page by the supplier.
5.2 Any eventual reimbursement to the purchaser will be credited in time by one of the methods proposed by the supplier and chosen by the purchaser.
5.3 All communications relating to payments take place on a special line of the supplier protected by encryption system. The supplier guarantees the storage of this information with an additional level of security encryption and in compliance with the current regulations regarding the protection of personal data.
5.4 Each payment by the purchaser can be done only by the methods indicated in the appropriate web page by the supplier.
5.5 Any eventual reimbursement to the purchaser will be credited in time by one of the methods proposed by the supplier and chosen by the purchaser.
5.5 All communications relating to payments take place on a special line of the supplier protected by encryption system. The supplier guarantees the storage of this information with an additional level of security encryption and in compliance with the current regulations regarding the protection of personal data.
6) TIMES AND METHOD OF DELIVERY
6.1 The supplier may begin to create the personalized photos after the payment has been made and after having received the following requisites from the purchaser:

Water or liquids to be analyzed (with written notice of origin and / or treatment)
6.2 The photographs, texts or voice files are transmitted to the supplier electronically at the address: info@wasserkristalle.eu. The water or liquids to be analyzed are sent to the following address: Zentrum für Wasserkristallfotografie - Rainer Niederkofler, Paul von Sternbach 1, 39031 Brunico (Italy).
6.3 The supplier sends the crystal photographs in jpeg format to the purchaser's email address.
6.4 The delivery times may vary from one day to a maximum of 30 working days after confirmation of the conditions according to point 6.1. Shipment times may vary from one day to a maximum of 30 working days after complying and confirming conditions in point 6.1. If the supplier is not able to ship within this period, the purchaser will be promptly notified by e-mail.
6.5 The supplier reserves the right to reject analyses.
6.6 The supplier provides the crystal images in a resolution of 19.8 megapixels and in the jpeg format.
6.7 The supplier transfers the copyright of the photos to the purchaser.
7) PRICES
7.1 All sale prices are displayed and indicated in EURO on the website http://www.wasserkristalle.eu.
7.2 The sale prices, referred to in the previous point, include VAT and any other tax. Shipping costs and any additional charges (eg customs clearance), even if not included in the purchase price, must be indicated and calculated in the purchase procedure before the order is placed by the buyer and contained in the order summary web page.
8) LIMITATION OF LIABILITY
8.1 The Supplier does not assume any responsibility for disservices due to force majeure failing to execute the order within the time stipulated in the contract.
8.2 The supplier cannot be held liable to the purchaser, except in cases of willful intent or gross negligence, for disservices or malfunctions connected to the use of the Internet outside of its own control or its sub-suppliers.
8.3 The Supplier is not responsable for any damages, losses and costs incurred by the purchaser because of the non-execution of the contract due to causes not attributable to him,
The purchaser is only entitled to full refund of the price paid and any eventual additional charges.
8.4 The supplier assumes no responsibility for any fraudulent and illegal use that may be made by third parties, credit cards, checks and other methods of payment, during payment process, if it proves to have adopted all possible precautions based on the best science and experience of the moment and based on ordinary diligence.
8.5 Under no circumstances the purchaser can be held liable for delays or errors in the payment if he proves that he has made the payment in the time and manner indicated by the supplier.
9) OBLIGATIONS OF THE PURCHASER
9.1 The Purchaser must to pay the price of the purchased good in the times and methods indicated in the Contract.
9.2 The purchaser provides, once the online purchase procedure is completed, for printing and storage of this contract.
9.3 The information contained in this contract has already been viewed and accepted by the purchaser. This step is obligatory before the purchase confirmation.
9.4 The purchaser is informed that this method differs from conventional water testing.This method shows the information and energy level of water.
9.5 The purchaser is informed that the present analysis does in no way replace the legally required drinking-water tests.
9.6 Crystal images may not be used to present and describe water as medicinal water.
9.7 The supplier assumes no liability for the use of water crystal images. The purchaser waives any warranty claims and assertion of claims in this regard.
9.8 The purchaser is not allowed to send any liquids that are dangerous or harmful to health.
9.9 The purchaser accepts the transport charges for liquids.
10) RIGHT OF WITHDRAWAL
The right of withdrawal cannot be exercised. The consumer law, art. 59, letter C) excludes the right of withdrawal for contracts of "supply of custom-made or clearly customized goods".
11) CAUSES OF RESOLUTION
The obligations referred to in paragraph 9.1, assumed by the purchaser, as well as the guarantee of the successful payment referred to art. 5.1, and the exact fulfillment of the obligations assumed by the supplier in point 6, are essential. The non-fulfilment only one of these obligations, if not determined by unforeseeable circumstances or force majeure, will result in the resolution of contract ex art.1156 of the Civil Code, without the need for a judicial decision.
12) PROTECTION OF CONFIDENTIALITY AND PROCESSING OF DATA OF THE PURCHASER
12.1 The supplier protects the privacy of its customers and guarantees that the processing of data complies with privacy legislation (Legislative Decree June 30, 2003, n. 196).
12.2 Personal data and tax information acquired directly and /or through third parties by the supplier Zentrum für Wasserkristallfotografie - Rainer Niederkofler, are collected and processed in paper form, computerized, telematics, in relation to the processing methods with the purpose of registering the order and activate the procedures for the execution of this contract and the related necessary communications, in addition to the fulfillment of any legal obligations, as well as to allow an effective management of business relationships to give the best requested service (art 24, paragraph 1, letter b, of Legislative Decree No. 196/2003).
12.3 The supplier undertakes to treat data and information transmitted by the purchaser with discretion and not to disclose it to unauthorized persons, or to use it for purposes other than those for which it was collected or to transmit it to third parties. Such data may be presented only upon request by the judicial authority or by other authorities authorized by law.
12.4 Personal data will be communicated, after signing a commitment of confidentiality, only to persons delegated to perform the necessary activities for the execution of the contract and communicated exclusively for that purpose.
12.5 The purchaser enjoys the rights referred to art. 7 of Legislative Decree 196/03.
12.6 The communication of personal data by the purchaser is a necessary condition for the correct and timely execution of this contract. Failing this, the purchaser’s request cannot be carried out.
12.7 In any case, the acquired data will be stored for a period not exceeding that necessary for the purposes for which they were collected or subsequently processed. However, their removal will be safe.
12.8 The holder of the collected and processed personal data is the supplier The purchaser can directly communicate with him.
13) METHOD OF STORAGE OF THE CONTRACT
Pursuant to art. 12 of D.L.vo 70/03, the supplier informs the purchaser that every order is stored in digital form on the server of the supplier according to criteria of confidentiality and security.
14) COMMUNICATIONS AND COMPLAINTS
Direct written communications to the supplier and any complaints will be considered valid only if sent to the following address: Zentrum für Wasserkristallfotografie - Rainer Niederkofler, Paul von Sternbach 1, 39031 Brunico or sent by e-mail to the following address info@wasserkristalle.eu. The purchaser indicates in the registration form his residence or domicile or e-mail address to which he wishes to receive communications from the supplier.
15) APPLICABLE LAW AND REFERENCE
This contract is governed by Italian law.
16) FINAL CLAUSE
This contract repeals and replaces any agreement, understanding, negotiation, written or oral, previously intervened between the parties and concerning the subject of this contract.
